By signing below, I am giving this Consent and Release to OC Volleyball LLC., in connection with the Project identified above. I represent to OC Volleyball LLC. I am at least the age of eighteen (18) years, (b) I am the parent or legal guardian of the participating athlete and I have the right to enter into this Consent and Release on my own behalf and without the consent of any other person and (c) this Consent and Release will not violate any other agreement or restriction applicable to me.

I acknowledge receipt of valuable consideration for this Consent and Release through the potential publicity from the use of my recorded/photographed image/voice and likeness for the Project, if they are used (and OC Volleyball LLC. may choose not to use it). I understand that I will receive no payments or royalties. I am entering into this Consent and Release voluntarily.

I hereby irrevocably consent to the use (including, but not limited to, reproduction, display, broadcasting, televising, publication and distribution in any media now or hereafter developed, including, but not limited to, broadcast, cable, satellite Internet, mobile, social media, promotions, interactive, print, industrial and out-of-home, without restriction or limitation) throughout the world and in perpetuity, of my name and/or image (or both), either in whole or in part, by OC Volleyball LLC. and their respective agents, licensees, nominees, affiliates, successors and assigns (and all others, including all media now in existence or hereafter created acting with the permission of) OC Volleyball LLC., for advertising, publicity, business, trade or art purposes or any other purpose. I agree that my name and/or image (or both) may be used either alone or in conjunction with sketches, cartoons, captions, films, artwork, textual matter or other photographs (including those of other persons), and may be edited as OC Volleyball LLC. deems appropriate.

I hereby release OC Volleyball LLC. and their respective agents, licensees, successors and assigns (and all others, including all media now in existence or hereafter created, acting with the permission of OC Volleyball LLC.), from any and all liability arising out of such use. I hereby assign to OC Volleyball LLC. to the fullest extent permissible by law (including by way of assignment of present and future rights), all copyright in the materials in connection with the Project, and OC Volleyball LLC. shall have all rights to register copyrights and renewals thereof. In addition, I hereby grant all consents in relation to rights in the materials and irrevocably and unconditionally waive any rights of privacy or publicity, moral rights and rights that I may have to inspect and/or approve the finished work or the advertising copy that may be used with the finished work. In the event of any claim by me against OC Volleyball LLC. I agree that my remedy will be limited to damages, if any, and I agree not to enjoin, rescind, or otherwise interfere with the use of my name as provided hereunder.

This Agreement shall be governed by the laws of the State of California, without regard to choice of law principles, and the applicable federal laws and international treaties of the United States of America. The courts of the State of California shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with this Agreement.

In consideration for being allowed entrance to OC Volleyball LLC for any sport or activity, I release from liability and waive my right to sue OC Volleyball, LLC., the owners of OC Volleyball, LLC., which own and operate OC Volleyball, LLC., their employees, officers, volunteers and agents from any and all claims, including the OC Volleyball, LLC. negligence, resulting in any physical injury, illness (including death) or economic loss that I may suffer because of my participation in this Activity, including any travel to and from the Activity.

I am voluntarily participating in this Activity. I understand that there are risks, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability or even death, which may occur from my participation in this Activity. These injuries or outcomes may arise from my own or other's actions, inactions, negligence, or from the condition of the Activity location(s) or facility(ies). Nonetheless, I assume all related risks, whether known or unknown to me, of my participation in this activity, including travel to and from the Activity.

I agree to hold OC Volleyball, LLC harmless from any and all claims, loss or damage to my personal property, liabilities and costs, including attorney's fees, as a result of my participation in this Activity, including travel to and from the Activity. If OC Volleyball, LLC incurs any of these types of expenses, I agree to reimburse OC Volleyball, LLC. If I need medical treatment, OC Volleyball, LLC. is authorized to obtain medical treatment for me. I will be financially responsible for any costs of such treatment. I agree that I will not hold OC Volleyball, LLC. responsible for any claims resulting from any medical treatment. I am aware that OC Volleyball, LLC. does not provide health insurance for me and I should carry my own health insurance.

I am 18 years or older. I have read this document, and I am signing it freely. I understand the legal consequences of signing this document, including (a) releasing OC Volleyball, LLC. from all liability, (b) waiver of my right to sue OC Volleyball, LLC. (c) and assumption of all risks of participating in this Activity, including travel to and from the Activity. I understand that this document is written to be as broad and inclusive as legally permitted by the State of California. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms.
